Tony and 13 others: If an individual passes away with a discretionary loan trust (multiple lives assured) in place and there is an outstanding loan of say £200k (and a chargeable gain of £100k causing tax at 40%) and the will did not state what should happen to the loan trust on death, do the trustees have to repay the outstanding loan back to the estate forcing the surrender of segments, thereby causing a chargeable gains (taxed at the marginal rate of tax assuming it’s surrendered in the same tax year of death)? Or can the loan be left to the spouse (as she’s the intended beneficiary to the outstanding loan anyway according to the will), therefore avoiding the surrender of segments? Click…
