I just met with some lovely prospect clients last night who set up a trust last year: Pretty large trust. They wanted to understand what it was since they took it out and then did not understand it - they explained it was the trainee that explained the original advice. I skimmed the suitability report, it was for a discounted gift trust so I explained that and said it was brilliant advice (I would have recommended the same). So I thought meeting over.

Then I am chatting to the settlor and she says she does not have enough income, so I asked where is the trust income going? Sea of blank faces from all 3 trustees; out comes 12 months bank statements from 2 bank accounts - it cannot be found. I then ask for a copy of the trust deed, that's found (we're now 2 hours in!). They've only gone and set up a discretionary trust with no carve-out!

Goodness knows how you deal with that asides complaint. But then how do you compensate for the lost income for the rest of her life? She really needs the money.

They're by no means HNW, but have enough to retire at this point. I'm leaning towards just pay the tax and invest the remaining £4-500k in a standard portfolio and live happily ever after as I don't think they will want VCTS etc. Anyone else have any bright ideas?
